Please read these terms carefully before using Magician Engine services.

1. Acceptance of Terms

By accessing or using any Magician Engine service — including our website, AI widgets, smart forms, service calendars, and platform packages — you agree to be bound by these Terms of Service. If you do not agree, do not use our services.

These Terms apply to all users, clients, and visitors. "You" refers to the individual or business entity using our services. "We," "us," and "our" refer to Magician Engine.

2. Services Provided

Magician Engine provides AI-powered website enhancement tools and managed services, including:

  • AI Chat Widgets for website visitor engagement and lead capture
  • AI Voice Widgets for inbound call handling and lead capture
  • Smart Forms for lead intake and pipeline routing
  • Smart Calendars for booking request management
  • Smart Website Platform packages bundling the above with setup and ongoing support

We reserve the right to modify, suspend, or discontinue any part of our services at any time with reasonable notice.

3. Subscriptions and Billing

Our services are provided on a monthly subscription basis. Subscriptions begin on the date your service is activated and renew automatically each month unless cancelled.

You authorize us to charge your payment method on file for the applicable monthly fee. Prices are listed on our website and may change with 30 days' notice.

All fees are non-refundable except as required by law or as explicitly stated in a written agreement between you and Magician Engine.

4. Cancellation

You may cancel your subscription at any time by contacting us via our Contact page. Cancellations take effect at the end of the current billing period. You will retain access to your service until that date.

We may cancel or suspend your service immediately if you violate these Terms, engage in fraudulent activity, or fail to pay outstanding amounts.

5. Your Responsibilities

By using our services, you agree to:

  • Provide accurate and complete information during onboarding and billing
  • Use our services only for lawful business purposes
  • Comply with all applicable laws, including those governing telemarketing, SMS communications (including A2P/10DLC regulations), and data privacy
  • Disclose to your website visitors that AI tools and lead capture technologies are in use
  • Not use our services to collect data from minors or to engage in spam, fraud, or deceptive practices

6. Intellectual Property

All content, tools, code, branding, and materials provided by Magician Engine remain our exclusive intellectual property. You may not copy, resell, white-label, or redistribute our tools or systems without written permission.

You retain ownership of your business data, lead information, and content you provide to us. By using our services, you grant us a limited license to process and display that content as needed to deliver the service.

7. Third-Party Platforms

Our services are built in part on third-party platforms including GoHighLevel, AI voice providers, and SMS/email delivery services. We are not responsible for outages, changes, or issues caused by those platforms. Their respective terms of service also apply to your use of services powered by them.

8. Limitation of Liability

To the maximum extent permitted by law, Magician Engine shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to lost revenue, lost leads, or business interruption, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from use of our services shall not exceed the fees you paid to us in the three months preceding the claim.

9. Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that our services will be uninterrupted, error-free, or that AI responses will be accurate in all cases. AI systems may occasionally produce incorrect or incomplete outputs.

10. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Tarrant County, Texas.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the date at the top of this page and, where appropriate, by email. Continued use of our services after changes constitutes acceptance.
